Service Overview
We are a digital marketing agency providing paid advertising services on third-party platforms, including but not limited to Google Ads, Meta Ads (Facebook & Instagram), and other advertising networks. All advertising campaigns are executed via these third-party platforms, over which we have no ownership or direct control.
No Performance Guarantees
While we aim to deliver the best possible outcomes for your business, we do not guarantee specific results such as a set number of leads, sales, or return on ad spend (ROAS). Advertising outcomes depend on various factors beyond our control, including market conditions, competition, platform policies, and consumer behavior.
Account Access and Management

- The client is responsible for providing necessary access to their advertising accounts, assets, and tools (if applicable) to enable service delivery.
- In cases where campaigns are run through Exponentials’ agency accounts, all data and assets remain the property of Exponentials.
- We are not liable for any issues arising from platform-related account bans, disapprovals, or suspensions.
Payments & Fees
- All service fees must be paid upfront before the start of each monthly service cycle.
- Paid advertising budgets are separate from our service fees and are to be maintained and funded directly by the client.
- Failure to make timely payments may result in immediate suspension of services without prior notice.
Termination of Services
- Either party may terminate the service agreement by providing written notice of 7 days.
- Exponentials reserves the right to suspend or terminate services at any time due to non-payment, unprofessional conduct, breach of these terms, or other reasonable grounds.
- No refunds will be issued for services already rendered or initiated.
Intellectual Property
- All ad creatives, copies, and strategies developed by Exponentials remain the intellectual property of the agency unless explicitly transferred in writing.
- Any use, reproduction, or redistribution of campaign strategies, structures, or assets without written consent is prohibited.
Limitation of Liability
- Exponentials shall not be held liable for:
- Platform-related issues, bans, or policy violations.
- Losses or damages arising from advertising campaigns, including but not limited to financial losses, missed business opportunities, or reputational harm.
- Any third-party platform changes, updates, or disruptions affecting campaign performance.
Confidentiality
Both parties agree to maintain the confidentiality of sensitive business, financial, and marketing information exchanged during the partnership.
Amendments
Exponentials reserves the right to modify these Terms & Conditions at any time. Updated versions will be posted on our website, and continued use of our services implies acceptance of any revised terms.
Governing Law
These Terms & Conditions are governed by the laws of India, and any disputes arising will be subject to the exclusive jurisdiction of the courts of Ajmer.
